1. Acceptance

By accessing or using Flapjack ("the Service"), you agree to be bound by these Terms of Service. If you do not agree, do not use the Service.

2. The Service

Flapjack is a hosted platform for building, deploying, and operating AI agents. We provide the infrastructure; you supply the configuration, prompts, data, and integrations that make up your agents.

3. Your Account

You are responsible for maintaining the confidentiality of your account credentials and API keys, and for all activity that occurs under your account. Notify us promptly if you suspect unauthorized access.

4. Acceptable Use

You agree not to use the Service to violate any law, infringe intellectual property rights, generate content that is illegal, harmful, or deceptive, attempt to disrupt or reverse-engineer the Service, or circumvent rate limits, quotas, or access controls.

5. Your Content

You retain ownership of the prompts, data, and outputs you submit or generate through the Service ("Your Content"). You grant us a limited license to host, process, and transmit Your Content solely to operate and improve the Service for you.

You are responsible for ensuring that Your Content and your use of the Service comply with applicable laws and the terms of any third-party model providers or integrations you connect.

6. Third-Party Services

Flapjack relies on third-party providers (model providers, infrastructure vendors, integrations you connect). Their availability, behavior, and pricing are outside our control, and your use of them is subject to their own terms.

7. Termination

You may stop using the Service at any time. We may suspend or terminate accounts that breach these Terms, pose a security risk, or remain inactive for extended periods. On termination, your right to access the Service ends and we may delete your data after a reasonable retention window.

8. Disclaimer

The Service is provided "as is" and "as available", without warranties of any kind. AI-generated output may be inaccurate, incomplete, or unsuitable for a given use case; you are responsible for reviewing it before relying on it.

9. Limitation of Liability

To the maximum extent permitted by law, Flapjack will not be liable for any indirect, incidental, special, consequential, or punitive damages, or any loss of profits, revenues, or data arising from your use of the Service.

10. Changes

We may update these Terms from time to time. Material changes will be communicated through the Service or by email. Continued use after changes take effect constitutes acceptance of the updated Terms.
